Terms and Conditions
1. Introduction
The Lock Father Ltd is a company registered in England and Wales under number 07844066 with a registered office of 1386 London Road, Leigh on Sea, Essex SS9 2UJ. The Lock Father Ltd ("TLF") provides a variety of services to its clients or potential clients ("the Client") including but not limited to all locksmith, security and related services.
2. Instructing us
a) By instructing TLF verbally, in writing or by any other means, you, the person, firm or authorised company representative become the 'Client' and authorise TLF to provide the services to you.
b) By becoming the Client, you agree to be bound by these Terms and Conditions.
c) TLF reserves the right to decline any instructions without stating a reason.
d) The Client hereby agrees that once TLF has received instructions in a manner as stated above they accept the cancellation fees for 'late cancellation' as described:
i) 'Late cancellation' is defined as cancelling an instruction within 24 hours of the services to be carried out.
ii) The fee for 'late cancellation' will be £125.00, plus VAT where applicable accepted upon the instruction of TLF to carry out the services.
3. Definition of the terms
These Terms and Conditions apply to the provision of services by TLF and no variation, alteration, substitution or modification of these Terms shall be binding on TLF unless expressly agreed by a Board Director of TLF. The Client agrees to be bound by these conditions upon instructing TLF.
4. Governing law
These Terms and Conditions shall be governed by and construed in accordance with the law of England & Wales, and each of the parties submits to the exclusive jurisdiction of the courts of England & Wales.
5. Cancellation of an instruction
The cancellation of an instruction must be made directly to TLF in writing. Charges may apply for late cancellation.
6. Locks/materials supplied
All locks remain the property of The Lock Father Ltd until paid for in full and by signing this Agreement or instructing us via email/text/Whatsapp or telephone the Client gives their full consent for all locks to be removed without prior notification or appointment if the Client fails to pay in accordance with the payment terms stated overleaf. No locks will be fitted by TLF that are supplied by others/third parties unless this has been previously agreed in advance in writing by TLF, unless these are part of a current master or restricted lock suite. If the locks are fitted without our acceptance or written notice a further charge of £40 per lock will be charged. This charge will be known as a 'fitting customers own lock service charge'.
7. Payment terms
The Client agrees to make payment within the timescales stipulated on the invoice. Where the Client has a credit account the Client agrees to make payment within the TLF's standard payment terms unless expressly agreed with a Board Director.
8. Late payment
a) TLF reserves the right to charge interest at four per cent above the UK Bank of England base rate on any balance outstanding in accordance with The Late Payment of Commercial Debts (Interest) Act 1998. The Client will also be contractually liable for payment of costs associated with debt recovery procedures, to include the costs payable to TLF's Lawyers where applicable, should the matter remain unpaid beyond the terms stated and legal proceedings are required.
b) Where the matter is passed to our chosen debt recovery agents to pursue recovery of the outstanding invoice, we reserve the right to charge an additional administrative fee of £80.00 plus VAT.
c) Where the debt recovery agents are unable to recover the sums due by way of their pre-legal collection procedures, TLF reserve the right to charge an additional administrative fee of £200.00 plus VAT in circumstances where legal or insolvency proceedings are instigated.
9. Your responsibilities
By instructing TLF the Client agrees to provide TLF with accurate information and documentation.
10. Warranties
TLF grant a 12-month warranty on all locks supplied and fitted. Please note that this warranty is voided by the following: door dropping, warping, expanding and contracting, misuse, the removal of the lock by a non TLF member of staff, subsidence, labour.
11. Liabilities
a) These terms do not affect our liability to you in any way for: personal injury or death arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter made by one of our employees or agents, nor any other liability which cannot be excluded or limited under applicable law.
b) This paragraph shall apply to any claim by you if any monies are held to be owed, to a claim by any individual or company, related or associated to you, and any employee of any of these entities; against TLF, any past, or future Directors, and/or any past, present or future employees of TLF.
c) All claims, whether made by one or more of the parties, arising from the same act or omission, or from a series of related acts or omissions, shall be regarded as one claim.
d) Any claim arising because of these terms must be notified to us in writing within 3 (three) months of the date that such liability arises. Failure to provide notice within this period will forfeit any claim.
12. Exclusions of liability
a) TLF will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if we had knowledge that such damages or loss might arise for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation: breach of contract, negligence, wilful act or default.
b) TLF shall bear no liability for loss and/or damage arising from matters outside of its control.
13. Complaints
TLF aims to provide a high-quality service to our clients. If you have a concern about the way your matter is being handled, please set out your complaint in writing to info@thelockfather.co.uk.
14. Data Protection Act 1998
a) TLF use the information you provide primarily for the provision of our services to you the Client and for related purposes including: updating and enhancing client records; analysis to help us manage our company; legal and regulatory compliance.
b) By instructing TLF we may send you information by email that we think might be of interest to you. If you do not wish to receive that information, please unsubscribe within the email received or notify our office in writing by email to info@thelockfather.co.uk.
15. General
a) These Terms and Conditions shall not affect any provision of the general law or professional standards applicable to the relationship between TLF and you the Client.
b) Any notice to be given to us may be sent to us at our principal place of business and, any notice to be given by us, may be given to you at your last postal and/or email address known to us.
18. Repeat work
Unless expressly varied, the terms of this document will also apply in respect of any future matters where one or more of the services is provided to the Client.
19. Amendments to our Terms and Conditions
a) TLF may revise these Terms and Conditions at any time. The amended Terms will be effective from the date they are posted on our website.
b) You, the Client, are expected to check these Terms from time to time to take notice of any binding changes that may have been made. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on our website and may include Regulatory or Legal changes. All revisions with the date to our T&C's are noted on the footer of all our emails that we send out.
